Discrimination in the Purchase or Sale of Property in Nova Scotia

Learn how the Nova Scotia Human Rights Act applies to discrimination in buying or selling property.

The purchase or sale of property is one of the seven prohibited areas identified by the Nova Scotia Human Rights Commission. Decisions or terms connected to a protected characteristic can therefore raise human-rights questions.

A distinct protected area

The purchase or sale of property is listed separately from rental housing. The legal analysis should identify which transaction and statutory area actually applies.

Refusal or different terms

A refusal to deal, discriminatory conditions or other disadvantage connected to a protected characteristic may engage the Act.

Agents and organizations

The facts may involve sellers, buyers, agents, businesses or other participants. Responsibility depends on the conduct, legal relationships and provisions of the Act.

Evidence

Listings, communications, offers, conditions, reasons given for a decision and evidence of differential treatment can be relevant.
