Publication, broadcasting and advertisement form one of the prohibited areas identified by the Nova Scotia Human Rights Commission. The statutory wording should be read carefully because this area engages expression as well as equality rights.

The protected area
The Act expressly addresses publication, broadcasting or advertisement. The legal question is not simply whether material is offensive; the relevant statutory prohibition and context must be established.
Advertising connected to other areas
Job or rental advertisements can also provide evidence of discriminatory eligibility criteria in employment or housing. More than one part of the Act may therefore be relevant to the same material.
Content and context
The words used, audience, medium, purpose and connection to protected characteristics can all matter. The current Act should be consulted before drawing conclusions about a publication.
Other legal frameworks
Defamation, criminal law, election rules, broadcasting regulation and constitutional expression rights are separate legal frameworks. A Human Rights Act analysis does not replace them.
