Response and Rebuttal in a Nova Scotia Human Rights Complaint

Understand the respondent's response and complainant's rebuttal stages after a human-rights complaint is signed.

Once a signed Complaint Form enters the Commission's complaint process, the respondent is given the complaint and an opportunity to respond in writing. The complainant can then submit a written rebuttal.

The respondent receives the complaint

The Commission provides the signed complaint to the respondent. That gives the respondent notice of the allegations being advanced through the process.

Written response

The respondent can provide its account, documents and position in a written response according to the Commission's procedure.

Complainant rebuttal

The complainant may submit a rebuttal, which the Commission says is shared with the respondent for information.

What follows

After the response and rebuttal process is complete or the submission periods expire, the complaint proceeds to File Flow Assessment. That assessment selects a procedural path and does not determine whether discrimination occurred.
